OFFICIAL RULES AND REGULATIONS

1. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED OR RESTRICTED: The Neurodiagnostic T-Shirt Slogan Contest (“Event”) begins at 12:00:00 a.m. Central Standard Time(“CST”) on June 18, 2018 and ends at 11:59:59 p.m. CST on July 3, 2018 (“Event period”): Open to residents of the United States, except Rhode Island, Florida, New York, and Puerto Rico and where prohibited by law, and shall be construed according to, and governed exclusively by the law of the State of Nebraska and any applicable United States law. By participating in the Event, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Aureus Medical Group® (“Sponsor”), which shall be final and binding in all respects.
2. ELIGIBILITY: The event is open to residents of the United States and who are the age of majority in their state of residence, excluding residents of New York, Rhode Island, Florida, and Puerto Rico. Employees and officers, their immediate families (parent, child, sibling & spouse) and persons living in the same households as such individuals (related or not) are not eligible to participate in the Event. Void outside the 50 United States and the District of Columbia. Void where prohibited or restricted by law, rule or regulation. All applicable federal, state and local laws and regulations apply.
3. HOW TO ENTER: To enter the Event, visit www.aureusmedical.com/neuro-slogan.aspx (“Event Website”). You will then arrive at the registration page. Complete entry form with your true and correct information and click “Submit”. By entering this event and after entering your registration information and clicking on the “Submit” button, you acknowledge and agree that you may be contacted by a representative from Aureus Medical Group regarding future job opportunities before and after the Event end date. Aureus Medical Group Cardiopulmonary/Allied Health staff, 13609 California Street, Omaha, NE 68154 will narrow the selections down to five (5) selections. Those five selections will then be posted to the website for visitors to vote. The submission with the greatest numbers of votes will be deemed the grand prize winner.
4. Event Prizes, Drawings, and Odds of Winning: One (1) grand prize winning slogan will be announced between July 17, 2018 and July 21, 2018. Eligible entries will be included in the selection process for the grand prize. Odds of winning depend on the number of eligible entries received. One Grand Prize Winner (“Winner”) will receive a $250 Visa Gift Card. Prize Restrictions: No prize substitution, cash equivalent of prize, transfer or assignment of prize permitted, except by Sponsor in its sole discretion, or as otherwise provided herein. Sponsor reserve the right to substitute the prize with one of comparable or greater value, at its sole discretion. The difference between ARV and the actual value of the prize will not be awarded. The Sponsor will award the available prize to the Winner only upon the grand Winner’s confirmation, verification and final approval by Sponsor. All prize details are at Sponsor’s sole discretion. All expenses not stated in these Official Rules are solely the responsibility of the winner. Winner is solely responsible for all applicable taxes not set forth herein and other expenses which may be required for the enjoyment and use of the prize. Taxes on the prize are solely the winner’s responsibility.
5. PRIZE AWARDING: Potential winner will receive prize notification via telephone and/or email within ten (10) days after the Event Drawing has been conducted that he/she has won and will have forty-eight (48) hours from receipt of winning notification to confirm that the notification has been received. If a potential winning entrant cannot be contacted; is ineligible; fails to claim the prize; if the prize notification is not returned; or if the potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prizes. After confirming notification receipt, the potential winner will be sent via email, United States Postal Mail and/or overnight mail an Affidavit of Eligibility/Compliance & Publicity /Liability Release forms and a W9 form. These forms must be completed, signed, notarized and returned to Aureus Medical within four (4) days. The potential winner then and only then becomes the winner. If the potential winner of any prize fails to return the completed and executed Affidavit and Release; fails to claim the prize; if the official paperwork is returned undeliverable; or if the potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize. Any taxes, fees, or incidental costs including but not limited to income taxes which may arise and be due or asserted on account of the prize shall be the sole responsibility of the winner. A 1099 tax form will be the responsibility of the winner if applicable. Winner agrees that receiving a prize grants Sponsor the right to print, publish, broadcast, and us universe-wide in any media now known or later developed at any time or times the winner’s name, portrait, picture, vice, likeness, and biographical information for any purpose, including but not limited to, in advertisements, publicity, and other communications without additional compensation, except where prohibited by law. Eligibility, age, and other claims made by winner are subject to verification. Prize winner grants Sponsor the right to use and publish winner’s proper name and state of residence online and in connection with the Event. All decisions of Sponsor and Event entities shall be binding and final. The Event entities do not assume any responsibility for any disruption in the Event caused by circumstance or other unforeseen events outside of the control of the Event entities. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Event materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control.
6. DISQUALIFICATION: Entrants found tampering with or abusing any aspect of this Event, as solely determined by Event entities, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate entrant’s eligibility to participate in the Event. Any attempt by any person to deliberately undermine the legitimate operation of the Event may be in violation of criminal and civil law, and, should such attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to terminate, cancel, suspend/modify the Event if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Event, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right but not the obligation, to award the prizes at random from among the eligible, non –suspect entries received up to the time of the impairment.
7. LIABILITY & RELEASE: By entering this Event, entrants and winner: (1) agree to be bound by these Official Rules; (2) agree to release to Sponsor, its subsidiaries, affiliates, divisions, advertising and promotion, fulfillment and/or judging agencies, as well as the respective officers, directors and employees of each (collectively, the “Released Parties”) from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this Event, or the acceptance, possession, use or misuse of any prize and claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery; (3) consent to the use of their entry, name, voice, picture, and likeness for advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law; (4) acknowledge that the Released Parties have neither made nor are responsible or liable for any warrant, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality or fitness for a particular purpose. Sponsor may discontinue this Event at any time; and (5) agree to release and hold harmless the Release Parties, including but not limited to Aureus Medical Group, its parents, affiliates and subsidiaries and the respective employees, officers and directors and divisions of each from and against any claim or cause of action arising out of participation in the Event or receipt or use of any prize hereunder, including, but not limited to: (a) unauthorized human intervention in the Event; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Event or the processing of entries; or (f) injury or death to a person(s) or damage to property which may be result, directly or indirectly, in whole or inpart, from entrant’s participation in the Event or entrants receipt, acceptance, use and/or enjoyment of any prize. In no event shall the Released Parties be liable for attorney’s fee. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
8. GENERAL: Sponsor may terminate any Event or decide to modify it in any manner what it deems fair and equitable to participants if it becomes aware of any occurrence that would materially affect Event security and fairness. Sponsor may prohibit individual from participating in Event and disqualify entries if they (1) attempt to enter the Event through any means other than as described in these Official Rules, (2) attempt to disrupt the Event or circumvent the terms and conditions of these Official Rules in any way or (3) repeatedly show a disregard for the Event Official Rules or act (a) in an unsportsmanlike manner, or (b) with an intent to annoy, abuse, threaten or harass any other entrant or Sponsor. Sponsor’s decisions with respect to the Event are final.
   T-shirt slogan entries must be original and not consist of copyrighted or trademarked ideas. It is the sole responsibility of each participant to ensure that the slogan does not infringe copyright, privacy rights, regulations, orders or directions of any third party. Slogan entries submitted to the contest should be the work of one person and must not have been used elsewhere or have won a prize in any other contest. Slogan entries will be disqualified for submissions that are not related to the topic or that engage in obscene, racist, violent, sexual or defamatory content. By entering the slogan contest, the winner grants exclusive rights to the winning slogan for use in any format. The winner agrees not to reproduce, use, transmit or exploit their slogans for other purposes than those of the contest.
9. TAX INFORMATION: All applicable federal, state, local, and other taxes on prizes are the sole responsibility applicable winner.
10. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Event or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Nebraska, County of Douglas. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, entrant’s rights and obligations, or the rights and obligation of the Sponsors in connection with the Event, shall be governed by, and construed in accordance with, the laws of the State of Nebraska, without giving effect to any choice of law of conflict of law rules (whether of the State of Nebraska or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Nebraska.
